Terms of Service

These terms describe the rules for using the Heym website, the source-available project, and any hosted, managed, or enterprise services that we directly provide. If you do not agree with these terms, do not use those services.

1. Acceptance of Terms

By accessing the Heym homepage, requesting support, or using any hosted or managed services we operate, you agree to these Terms of Service. Additional written agreements may apply to enterprise customers and will control in the event of a conflict.

Heym is a source-available, self-hosted AI workflow automation platform that allows users to build, manage, and execute intelligent automations through a visual drag-and-drop canvas. These terms apply to the website at heym.run, the source-available project distributed via GitHub, and any hosted or managed services we directly operate on behalf of customers.

2. Eligibility and Accounts

You must have the legal authority to enter into these terms on behalf of yourself or your organization. If an account is required for a particular service, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

When you create an account on a Heym instance that we operate, you provide an email address and password. Authentication is handled through JSON Web Tokens stored in HttpOnly cookies. You should use a strong, unique password and notify us promptly if you suspect unauthorized access to your account. We reserve the right to suspend accounts that show signs of compromise or abuse.

3. Acceptable Use

Heym is designed for building AI-powered workflow automations, including tasks like data processing, content generation, customer support, DevOps automation, and sales operations. You may use Heym for any lawful purpose that falls within the intended functionality of the platform. You agree not to use Heym to:

  • Violate applicable law, regulations, sanctions, or third-party rights.
  • Transmit malware, spam, abusive automation, or deceptive content.
  • Interfere with the security, integrity, or availability of our systems.
  • Attempt unauthorized access, reverse engineer restricted services, or bypass limits.
  • Process personal data unlawfully or without the permissions your use case requires.
  • Use the AI Assistant, Agent nodes, or LLM integrations to generate content that violates the acceptable use policies of the underlying model providers such as OpenAI, Anthropic, Cohere, or Ollama.
  • Scrape, crawl, or extract data from websites using Playwright or Crawler nodes in a manner that violates the target website's terms of service or applicable law.

We encourage responsible use of AI capabilities. If you configure guardrail nodes, content filters, or human-in-the-loop approval checkpoints within your workflows, you are responsible for ensuring those safeguards are appropriate for your use case and regulatory environment.

4. Source-Available License and Hosted Services

The Heym source code is made available under the Commons Clause plus MIT licensing model. The Commons Clause restricts selling the software or offering it as a paid hosted service, but you are free to use, modify, and distribute the code for your own purposes. Your use of the repository and distributed code is governed by the applicable license files in the project.

Hosted, managed, or enterprise services may include additional operational, security, or support terms. Nothing in these Terms of Service transfers ownership of the Heym software or our branding to you. Self-hosted deployments are entirely under your control — you are responsible for infrastructure, backups, security patches, and compliance with any regulations that apply to your use case.

Contributions to the source-available project, including pull requests, bug reports, and feature suggestions submitted through GitHub, are subject to the project's contribution guidelines and the license under which the project is distributed.

5. AI Features and Outputs

Heym includes AI-powered features such as the visual canvas AI Assistant, LLM nodes for text generation and analysis, Agent nodes for multi-step autonomous tasks, RAG nodes for retrieval-augmented generation with Qdrant vector stores, and guardrail nodes for content safety filtering. These features connect to third-party model providers including OpenAI, Ollama, vLLM, and Cohere through API credentials you configure.

You are responsible for reviewing, testing, and validating all AI-generated outputs before relying on them in production or regulated environments. AI models can produce inaccurate, biased, or unexpected results. The quality of outputs depends on your prompts, model selection, temperature settings, and the data you provide through RAG pipelines or skill attachments.

Third-party models, APIs, or integrations used in connection with Heym remain subject to their own terms and policies. You are responsible for ensuring that your use of these services complies with their respective acceptable use policies, rate limits, and data processing agreements.

6. Availability and Changes

We may update, suspend, or discontinue features from time to time. We aim to keep our services reliable, but we do not guarantee uninterrupted availability, specific uptime, or error-free operation unless explicitly stated in a separate written agreement.

The Heym platform is under active development. New node types, dashboard features, expression DSL functions, and integration capabilities are added regularly. We may deprecate or modify existing functionality with reasonable notice. For self-hosted deployments, you control when and whether to apply updates. For hosted services, we will provide advance notice of breaking changes whenever practical.

7. Fees and Enterprise Engagements

The source-available version of Heym is free to use and self-host without any licensing fees. Some services, support packages, or enterprise engagements may require payment under a separate order form, invoice, or written agreement. Enterprise offerings may include priority support with SLA guarantees, custom development, dedicated infrastructure, advanced security features, and compliance assistance. Unless otherwise stated, fees are non-refundable once the agreed work or service period begins.

8. Intellectual Property

Heym, its website, branding, and service materials remain our property or the property of our licensors. You retain rights to your own content, workflows, and data, subject to any permissions needed for us to operate the service you request.

Workflow definitions, templates, skills, credentials, vector store contents, DataTable data, and any other content you create within Heym belong to you. We do not claim ownership over your workflows or the outputs they generate. When you share workflows, templates, or credentials with team members through the Teams feature, you grant those team members access according to the permissions you configure.

9. Disclaimers

Heym is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be error-free, that AI-generated outputs will be accurate, or that integrations with third-party services will function without interruption.

Self-hosted deployments operate entirely on your infrastructure. We are not responsible for the security, availability, or performance of your self-hosted environment, including database backups, network configuration, container orchestration, or the behavior of third-party LLM providers you connect through your own API keys.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data arising from or related to your use of Heym.

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising from these terms or your use of Heym services will not exceed the amounts you have paid us in the twelve months preceding the claim, or one hundred euros, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless Heym and its operators from claims, damages, liabilities, and expenses arising out of your unlawful use of the service, your breach of these terms, or your violation of another party's rights. This includes claims arising from workflows you build, AI outputs you deploy, data you process through the platform, and any content you share through Portal chat interfaces or public review links.

12. Termination

We may suspend or terminate access to services we operate if you violate these terms, create security risk, or use the service in a way that could harm us or others. You may stop using Heym at any time.

Upon termination of a hosted service account, we will make reasonable efforts to allow you to export your data, including workflow definitions, credentials metadata, and DataTable contents. After a reasonable retention period following account closure, we may delete your data from our systems. For self-hosted deployments, termination of these terms does not affect your existing installation, but you must continue to comply with the applicable source-available license.

13. Governing Law

These Terms of Service are governed by the laws of Germany, excluding conflict-of-law rules. Unless a separate written agreement states otherwise, disputes will be resolved in the courts located in Berlin, Germany. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date on this page. Your continued use of applicable services after changes take effect means the revised terms apply going forward. For material changes that significantly affect your rights or obligations, we will provide notice through the website, email, or the Heym dashboard at least thirty days before the changes take effect.
